About Alabama consumable hemp law

Since January 1, 2026, Alabama regulates consumable hemp products under Code of Alabama Title 28, Chapter 12 (from HB 445). Retail sales require an Alabama ABC Board license, and products must meet testing, labeling, and packaging rules.

What changed

Chapter 12 authorizes the Alcoholic Beverage Control Board to license retailers of consumable hemp products, requires independent batch testing and compliant packaging, sets THC serving and container limits, and creates enforcement tools (including seizure and penalties). It also prohibits sales to minors, smokable hemp products, and online sales or direct delivery of consumable hemp products.

Who can sell

Effective January 1, 2026, consumable hemp products may only be sold in Alabama by retailers licensed by the ABC Board. The Board describes three license categories:

  • Consumable Hemp Products Retail Food Store License
  • Consumable Hemp Products Pharmacy License
  • Consumable Hemp Products Specialty Retailer License

Product rules (high level)

  • Sales only to adults 21 and older.
  • No smokable hemp products.
  • No online sales or direct delivery.
  • Beverage serving limits include no more than 10 mg total THC per serving (and related container rules under ABC regulation).
  • Edible products are individually wrapped single-serve packs, each not exceeding 10 mg total THC, with carton caps under statute and rule.
  • Other products (e.g. topical / sublingual) are subject to container THC caps (commonly 40 mg total THC per container under ABC rule).
  • Packaging must be child-resistant and may not use child-appealing cartoon imagery or branding that misleads about the contents.

Label approval

Manufacturers may request ABC label approval (with a fee) before a product is sold, shipped, or distributed into Alabama. Approved labels are listed publicly by the Board. Labels must include ingredients, batch information, THC amounts, COA-linked QR/barcode, dates, and required warnings.
